Open Access Policy
The Journal of Malay Constitutional Studies (JMCS) is an open-access scholarly journal. The journal is committed to making scholarly research freely and immediately available to readers and to supporting the wider dissemination of knowledge in constitutional law, constitutional theory, Malay constitutionalism, and related fields.
1. Immediate Open Access
All scholarly articles published by JMCS are made freely available online upon publication. Readers are not required to pay subscription or access fees to read published articles.
JMCS does not impose an embargo period on access to its published scholarly content.
2. Free Access to Scholarly Knowledge
JMCS supports the principle that providing free access to scholarly research contributes to the exchange and development of knowledge.
Published articles may be accessed by researchers, academics, students, practitioners, policymakers, institutions, and members of the public without subscription barriers.
3. Creative Commons Licence
Articles published in JMCS are made available under the Creative Commons Attribution 4.0 International Licence (CC BY 4.0), unless otherwise indicated.
Under this licence, users may share and adapt published material for lawful purposes, provided that appropriate credit is given to the original author or authors, a reference to the licence is provided, and any changes made to the original material are appropriately indicated.
4. Attribution
Users who reproduce, distribute, adapt, translate, or otherwise reuse material published by JMCS must provide appropriate attribution to the original author or authors and the original publication.
Attribution should, where reasonably possible, include the author's name, article title, journal title, publication details, and other information necessary to identify the original work.
5. Author Rights
Open access does not remove the rights of authors in their scholarly work. Authors retain the rights provided under the journal's copyright and licensing arrangements while granting the permissions necessary for publication and dissemination through JMCS.
The specific rights and responsibilities of authors are governed by the journal's Copyright and Licensing Policy and the applicable Creative Commons licence.
6. Reader Rights
Readers may access, read, download, share, and use JMCS articles in accordance with the terms of the applicable Creative Commons licence.
No permission from JMCS is required for uses already permitted under the applicable licence, provided that the licence conditions are satisfied.
7. Third-Party Material
Material contained within an article that is owned by a third party may be subject to separate copyright or licensing conditions.
Authors are responsible for identifying third-party material and obtaining any permissions required for its publication. The Creative Commons licence applicable to a JMCS article does not automatically apply to third-party material where a different rights statement is indicated.
8. Accessibility and Dissemination
JMCS seeks to facilitate broad scholarly dissemination by making its published research available through its online publishing platform.
The journal encourages lawful sharing, citation, scholarly discussion, and responsible reuse of published research in accordance with the applicable licence.
9. No Access Charges for Readers
JMCS does not charge readers for access to published scholarly articles. Articles may be read online without a paid subscription.
This provision concerns reader access and is separate from any policy concerning fees associated with manuscript submission, processing, or publication.
10. Relationship with Other Journal Policies
This Open Access Policy should be read together with the journal's Copyright and Licensing Policy, Publication Ethics and Malpractice Statement, and other applicable editorial policies.
JMCS is committed to promoting accessible, responsible, and ethically published scholarship while respecting authorship, attribution, copyright, and academic integrity.
